Bandara — Terms of Service

1. Who we are
Bandara is operated by Hendeka Orchestra, an independent project run by a private individual (sole trader) established in Spain (the "Operator"). Contact: bandara@hendekaorchestra.com. "Hendeka Orchestra" and "Bandara" are trade names of the Operator. Full seller identification is available on request at the contact address.
2. The service
Bandara is a weekly radar for public tenders, grants and funding opportunities (EU Funding & Tenders, TED, incentivi.gov.it and other qualified public sources) for software houses, SaaS companies and tech SMEs. It normalises requirements, deadlines and budgets and produces a scored shortlist (Top / Watch / Ignore). It reduces research noise; it does not replace professional review.
3. Intelligence, not advice — no outcome promise
Scores and shortlists are generated algorithmically. Bandara does not guarantee eligibility, selection, award or funding success, does not write bids or applications, does not speak to public bodies on your behalf, does not certify eligibility, and provides no legal, financial or grant-writing advice. Before acting you must verify conditions, deadlines, documents and submission rules on the official source. Report and email drafts are starting points for review, not applications ready to submit.
4. Accounts
Accurate information, secure credentials, one account per organisation/person, minimum age 16. Google sign-in is authentication only. We may suspend accounts breaching these Terms.
5. Plans, billing, activation, renewal
- Plans: Starter €99/mo (1 profile) · Pro €249/mo (2 profiles, dashboard, alerts) · Agency €499/mo (up to 10 profiles, white-label, export).
- Pilot phase: access is activated manually within 1 business day of subscription. The service period starts at activation, not at payment. If we cannot activate within 3 business days, you may cancel for a full refund.
- Billed in advance via Stripe; auto-renewal each period until cancelled. Cancel any time; access continues to the end of the paid period.
- All prices are final prices, inclusive of any applicable taxes. Business customers should provide a valid VAT/tax ID for their records.
- Price changes: 30 days' email notice.
6. Refunds and withdrawal
See the Refund Policy. Summary: full refund any time before manual activation; EU consumers keep the 14-day withdrawal right with the immediate-performance waiver from activation.
7. Acceptable use and licence
Internal business use; white-label reports (Agency) may be shared with your own clients as permitted by your plan. You agree not to: scrape or bulk-extract beyond provided interfaces; circumvent access or rate limits; resell or redistribute Bandara output as a competing dataset; present output to third parties as professional advice; attempt unauthorised access.
8. Availability and data quality
Source APIs and public portals may be unavailable, incomplete or delayed. Bandara may degrade, flag sources as stale, or omit uncertain items — flagging uncertainty instead of inventing confidence is part of the design. Service provided "as is" and "as available"; no SLA unless separately agreed in writing.
9. Limitation of liability
Total aggregate liability limited to amounts paid in the 12 months preceding the event (free users: €0). No liability for indirect or consequential damages, lost profits, lost funding opportunities, or missed deadlines. Nothing excludes or limits liability for death or personal injury, fraud, wilful misconduct or gross negligence, or any liability and consumer rights that cannot be excluded or limited under mandatory Spanish/EU law.
10. Termination
Close your account at any time. Termination by us without your breach → pro-rata refund of the unused period.
11. Changes
Material changes: 30 days' email notice; non-acceptance → cancel with pro-rata refund of prepaid unused period.
12. Governing law and jurisdiction
These Terms are governed by Spanish law, subject to directly applicable EU law and mandatory consumer-protection rules. Jurisdiction is determined by applicable mandatory law. Consumers retain every right to sue or be sued before the courts competent for their country of residence where mandatory law so provides.
